2. Scope & Purpose
These Terms and Conditions govern:
- The use of our official website (including the Blog, the Learn Peruvian Spanish resource hub, and our Library platform), and linked social media channels.
- The contracting of our custom digital services, which include text formatting, interior layout typesetting, independent author publishing consultation, and editorial design.
- The access, download, and purchase of digital products (eBooks, learning guides, educational materials, and digital media assets) managed via our own online shop or through external global distribution networks.
3. Digital Retail Products & Multi-Platform Sales
Aflore’s digital products are available across multiple distribution channels.
- Third-Party Platforms (e.g., Amazon, Draft2Digital partners): Digital eBooks and resources may be purchased through our distribution partners. Transactions, payment processing, and platform-specific customer service for these items are governed strictly by the respective terms of those external networks. Aflore is not liable for checkout errors or download access issues occurring on third-party servers.
- Direct Purchases: Orders are officially placed when you complete our secure on-site checkout. An automated confirmation email will be generated upon successful payment authorisation.
4. Custom Digital Services
For layout design, text formatting, editorial proofreading, or independent publishing consultancy, administrative setups are initiated directly via our customer service channels.
- For standard custom packages, clients must explicitly confirm their acceptance of our project scope in writing before work begins.
- For large-scale independent publishing projects, a separate baseline Service Agreement (Contract) must be signed by both parties.
- Once an inquiry is received, we will issue a formal proposal detailing project milestones, digital delivery timelines, and costs. All service orders are subject to the guidelines set out within the Bespoke & Custom Services Policy Addendum (Section 17).
5. Payment Conditions
- Online Shop Purchases: All retail digital products and direct library downloads purchased through our online store must be paid for in full (100%) at the time of checkout before file access or download links are granted.
- Custom Services: For all bespoke digital design, formatting, or independent editorial services, the following structured payment schedule applies:
- 50% Advance Payment: Required upfront to secure project scheduling and initiate design, structuring, or editorial analysis.
- 50% Final Balance: Due immediately upon project completion, prior to the final handoff of print-ready PDFs, EPUB files, or master digital assets.
Project Cancellation Rule: If a client chooses to cancel a custom service package after formatting or active editing has commenced, Aflore reserves the right to retain a calculated percentage of the initial 50% deposit to cover logged studio hours and milestones achieved up to that exact date.
6. Client-Provided Content & Intellectual Property Warranties
- Aflore reserves the absolute right to reject any custom service order or manuscript whose content is deemed offensive, discriminatory, harmful, or contrary to our ethical and aesthetic values.
- The client guarantees that all content submitted to Aflore (including manuscripts, texts, images, illustrations, and fonts) belongs to them or that they possess all necessary licences, copyrights, and reproduction rights.
- Aflore assumes absolutely no legal liability regarding unauthorised copyright or intellectual property infringement within content provided by the client.
7. Digital Products, eBooks & The Digital Library
- The Library: Aflore offers direct access to reading materials, digital downloads, or media files through our on-site Library. Files downloaded directly from our digital Library are intended strictly for personal, non-commercial educational use.
- Restrictions: You may not re-upload, bundle, resell, or commercially redistribute any digital assets, PDFs, or audio materials obtained from our platform without our express written consent.
- Technical Liability: While we ensure all downloadable files are clean, optimised, and verified, files are downloaded at the user’s own discretion. Aflore is not liable for temporary internet-side data interruptions or browser-side download failures.
8. Warranties & Liability Disclaimers
- Aflore guarantees the high professional quality of our digital formatting and editorial assets. If a structural file error occurs that is directly attributable to us (such as corrupted files or layout formatting mismatches against the approved final proof), we will rectify the file at no additional cost to the client.
- We are not responsible for editorial or design errors resulting from incorrect formatting specifications, low-resolution images supplied by the client, or typos present in client-submitted files if those files were previously approved for final delivery by the client.
9. Core Intellectual Property Rights
- All original content created by Aflore (including web text, educational guides, vocabulary databases, lesson structures hosted on the Learn Peruvian Spanish hub, articles within the Blog, downloadable files in the Library, brand typography, and logos) remains the exclusive property of Taller Grafico Aflore E.I.R.L.
- Any unauthorised reproduction, adaptation, modification, or distribution of these assets without our express, written consent is strictly prohibited.
- For publications created in partnership with independent creators, proper authorship, credit lines, and copyright ownership will be prominently displayed within the digital publication, governed by specific individual contracts.
10. Learn Peruvian Spanish Hub, Blog & Subscriptions
- Educational Content Purpose: All linguistic data, vocabulary lists, cultural articles, and audio-visual tips provided within our platform are for general informational and educational purposes. Language learning progress depends entirely on individual student commitment.
- Automated Subscriptions: Subscribing to receive automated email notifications does not create a private membership portal or user account. Submitted email addresses are processed securely and will never be shared with third parties. Users can opt out instantly via the unsubscribe link contained in any notification email.
11. Use of Subcontractors
Aflore reserves the right to collaborate with vetted, professional freelance contractors (such as specialised proofreaders, graphic artists, and layout designers) to execute specific stages of an editorial project. In all cases, Aflore remains the final point of contact and holds full accountability for delivering the project according to our quality benchmarks.
12. Force Majeure
Aflore shall not be held liable or responsible for service delivery failures or digital platform access delays caused by circumstances beyond our reasonable control. This includes natural disasters, civil unrest, national emergencies, prolonged regional utility or hosting network outages, or global internet backbone disruptions.
13. Website & Social Media Content Use
All content hosted on our website and social channels may be browsed or shared strictly for personal, non-commercial purposes, provided it remains unaltered and properly credited to Aflore.
- External Collaborations: Submitting guest articles or literary excerpts to Aflore does not grant us exclusive copyright ownership; we are simply licensed to host the material across our digital platforms. Collaborators can request the modification or deletion of their content at any time by reaching out through our official contact channels.
14. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Peru. In the event of a contractual dispute, both parties agree to first seek an amicable, good-faith resolution. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of the City of Lima.
15. Cookies & Platform Technologies
Because the Aflore website is built on the WordPress framework and hosted via Hostinger.com, standard cookies and tracking web technologies are utilised by the platform infrastructure to enhance navigation speed, track basic visitor traffic analytics, and remember interface preferences. Aflore does not deploy proprietary tracking scripts, nor do we harvest or store private user browsing data.
16. Amendments to These Terms
Aflore reserves the right to modify or replace these Terms and Conditions at any time. The current, legally binding version will always be accessible on this page alongside its latest revision date. Structural amendments will never retroactively affect pricing or delivery commitments for projects that have already been paid for and confirmed.
17. Bespoke & Custom Services Policy (Addendum)
This section acts as an official addendum to our general terms and specifically governs all manual layout commissions, digital design, and author services managed directly through our communication channels.
17.1 Scope of Editorial Services
Our studio specializes in comprehensive digital editorial preparation:
- Editorial Services: Professional orthotypographic and stylistic proofreading, interior layout typesetting, custom book cover formatting, and independent digital publishing guidance.
17.2 Technical File Specifications
To maintain professional production standards, the client must submit digital assets according to the following strict technical baselines:
- Book Layouts & Text Manuscripts: Delivered in a clean text format or flattened PDF format with precise margins and a minimum structural resolution of 300 dpi for embedded assets.
- Photography & Graphic Illustrations: Delivered in high-resolution PNG, TIFF, or JPG formats, preset to a minimum resolution of 300 dpi at actual target print dimensions.
17.3 Final Approvals, Modifications & Cancellations
Clients may request layout adjustments or asset updates at any time before providing final written confirmation (via WhatsApp or email) stating that files are ready for master export. Once final files are generated and delivered, layouts are locked.
If a client requests a modification or cancellation after formatting or active editing has actively commenced, Aflore will retain a calculated percentage of the initial 50% advance payment to directly compensate for logged studio hours and administrative milestones achieved up to that date.
17.4 Production Errors & Revision Warranties
- Errors Attributable to Aflore: If a finished digital file suffers from clear structural defects directly caused by our studio (such as broken page flows or design layout deviations from the approved proofs), Aflore will correct and re-export the affected assets completely free of charge.
- Errors Attributable to the Client: If the final file reflects typos, low-resolution blurring, or structural formatting errors that were present within the source files approved by the client, Aflore cannot assume the cost of a complimentary re-edit.
17.5 Studio Marketing Rights
Aflore reserves the right to display digital previews, book covers, and formatted layout spreads within our promotional portfolios, digital catalogues, and social media channels, always ensuring original authors and designers are prominently tagged and credited. If you prefer to keep your project completely confidential, please explicitly inform us in writing during your initial quotation phase.
17.6 Direct Payment Methods & Electronic Invoicing
- Accepted National Payment Gateways (Peru): Digital balances for custom work can be processed via Yape, Plin, or direct national bank transfers.
- Accepted International Payment Gateways: Global clients may settle invoices via PayPal, Global66, Payoneer, or direct international wire transfers. All transaction fees and currency conversion spreads are the exclusive responsibility of the client.
- Legal Electronic Invoicing: Upon successful receipt of the final 50% balance payment at project completion, Aflore will generate and dispatch a formal electronic invoice (Boleta Electrónica to individuals or Factura Electrónica to registered corporate entities with a valid business RUC number).
